02 29.04.2011 Both the above stated petitions arise out of Lodipur P.S.
Case No. 04 of 2011 registered under Sections 3, 4 and 5 of
Explosive Substance Act and accordingly, both the above stated
petitions are being disposed of by this common order.
Although, petitioners are named in the first information
report and admittedly, they have sustained some injuries but
submission on their behalf is that on the alleged date of occurrence
while they were talking, an explosion took place in which they
sustained injuries and subsequently, they were taken to hospital. It is
also pointed out on their behalf that petitioner in Cr. Misc. No.
13008 of 2011 does not have any criminal antecedent whereas
petitioner in Cr. Misc. No. 12585 of 2011 was made accused in three
cases but he has already been granted bail in almost all the above
stated three cases.
Considering the aforesaid facts and circumstances as well
as submissions of the parties, let the petitioners be released on bail
on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with
two sureties of the like amount each to the satisfaction of Chief
Judicial Magistrate, Bhagalpur in connection with Lodipur P.S. Case
No. 04 of 2011.
