1.0 On
17th August 2010, the Court passed an order, relevant part
of which reads as under:

Learned
advocate Mr. Darji appearing for
Mr. Mrugen K. Purohit states that
process of this Court is served to the opponent on 16th
August 2010. With a view to give an opportunity to the
opponent the matter is kept on 26 th
August 2010.

1.1 Today
also, no appearance is caused on behalf of the opponent GSRTC.

2.0 Having
heard the learned advocate Mr. Darji and having gone through the
contents of the Civil Application, more particularly, Para 4, the
application is allowed. The delay is condoned. Rule is made
absolute with no order as to costs.

2.1 The
First Appeal to be listed on 31st
August 2010.
