FACTS

By his letter of 12/01/2008, addressed to CMD, NBCC, the Appellant had sought
information about non-payment of about Rs.49 lacs to him against the works executed by
him at Agra.

2. CPIO have responded to him vide letter dated 11/02/2008 mentioning therein that
the matter was under process.

3. On Appeal, Appellate Authority had upheld the decision of the CPIO vide letter
dated 17/05/2008.

4. The present Appeal is directed against the order of the CPIO/AA.

5. The matter was heard on 20/02/2009. The Appellant appeared before the
Commission. The Public Authority is represented by the officer named above. The
core issue herein is non-payment of the outstanding amounts to the Appellant by NBCC.
It is Shri Singh’s submission that the Appellant had not completed the works in time had
also exceeded the quantity of work as against the assigned quantity. It is his say that due
to this reason processing of the matter is taking time.

6. It is, however, noticed that the work was executed about six years back and yet no
final decision about payment has been taken by NBCC. It is a serious matter, more so
when NBCC is a prestigious institution of the Government of India.

DECISION

7. The CPIO is directed to expedite the processing of the claim of the Appellant and
inform him ABOUT the decision in next four weeks time.

8. However, if the Appellant is not satisfied with the decision of CPIO, he would be
at liberty to move the Commission again.

9. The matter is disposed of subject to the above directions.
