Shri Bireshwar Nath, learned counsel for the C.B.I. says that despite a
month’s time granted to him, instructions could not be received.
From the other side, learned counsel for the petitioner says that vide order
dated 15.4.2010 passed in similar writ petition no.3300 (M/B) of 2010 :
Mahendra Nath Ram and others Vs. State of U.P. and others, on the basis of
the statement made by Shri Bireshwar Nath, petitioners of that case were not
going to be arrested in respect of the same case crime, therefore an interim
protection be also given to him.
In view of the above, Shri Bireshwar Nath is given two days time to seek
instructions.
