Counsel for the petitioner states that in terms of the order dated

May 30, 2008, goods of the petitioner have been released on furnishing

bank guarantee of the amount of tax as well as penalty. He further states that

in this case, the penalty order has already been passed, but copy of the same

has not been supplied to the petitioner and the petitioner intends to file

appeal against the order of penalty. In view of this fact, counsel for the

petitioner states that the petitioner may be permitted to withdraw this

petition with liberty to file an appeal against the order of penalty, by taking

all the pleas taken here in this petition, with further liberty to avail its other
CWP No. 7844 of 2008 -2-

remedies for the alleged harassment of the petitioner by the authorities.

Dismissed as withdrawn with the aforesaid liberty. If copy of

the penalty order has not been supplied to the petitioner, the respondents are

directed to supply the same to the petitioner within a period of seven days.
