Heard learned counsel for the applicant and the learned A.G.A.
It is argued by the learned counsel for the applicant that the co-accused Harish
Chandra was granted bail by an earlier order of this Court dated 19.6.2007
and that the case of the applicant is similar. Learned AGA, however, argued
that the co-accused was granted bail because it was mentioned in the order
that the wife of the deceased Soni was having illicit relation with the applicant
and the co-accused Harish Chandra was the father of the applicant and that he
would not have been party to the said illicit relations. It was further argued
by the learned counsel for the applicant that there is no evidence against the
applicant.
Learned AGA states that now the trial must be at the concluding stages and it
will not be proper for the court to release the applicant at this stage.
In view of above, the bail application is rejected. However, trial court is
directed to conclude the trial, if possible within three months of filing of a
certified copy of this order.
