ORAL ORDER
Mr.
Joshi for the respondent has placed on record a copy of the
settlement dated 20.12.2006 entered into by and between the
respondent company and the petitioner union. The said settlement
dated 20.12.2006 is taken on record.
It
is also informed by Mr. Joshi, advocate for respondent, that the said
settlement is signed by seven representatives of the petitioner union
and also the advocate representing the union in the trial court and
that one of the signatories to the settlement is the deponent i.e.
Mr. Harshadbhai of the petition. The settlement is also signed by two
representatives of the company.
It
is further informed by Mr. Joshi that in view of the settlement, the
subject matter of the petition, has been settled inter-se between the
parties.
Ms.
Fernandis for Mr. Raval is present in the court. She has made request
for sometime. The fact about the settlement was informed to the court
earlier on 24.4.2008 also and only for the purpose of confirmation of
the said aspect, the matters were adjourned at the request of Mr.
Raval.
Today,
copy of the settlement, of which reference was made on 24.4.2008, is
placed on record and on the basis of the said settlement it is
submitted on behalf of the respondent company that dispute has been
settled.
In
that view of the matter, the petitions are disposed of in terms of
the settlement. Parties are directed to abide by the said settlement.
In case of any difficulty, it would be open for the advocate for the
petitioner to approach this court with appropriate request.
With
the aforesaid observation and direction, petitions are disposed of.
