                                      JUDGMENT

Petitioner is the plaintiff in O.S.No.249 of 2008 of the court of learned

Munsiff, Adoor. He sought for a decree for prohibitory injunction against

respondents obstructing construction of damaged boundaries of the suit

property. He filed Ext.P2, application for an order of temporary injunction under

Order XXXIX Rule 1 of the Code of Civil Procedure. Grievance of petitioner is

that until now that application has not been disposed of. On account of that,

petitioner is suffering much inconvenience. Petitioner therefore seeks a

direction to the learned Munsiff for early disposal of Ext.P2. It is pointed out by

learned counsel that the case stands posted to 17.09.2010. I make it clear that it

is open to the petitioner to seek advancement of hearing of Ext.P2, application.

2. Having regard to the facts and circumstances of the case and

considering that Ext.P2, application was filed in the year 2008 learned Munsiff,

Adoor is directed to dispose of Ext.P2, application as expeditiously as possible.

Writ Petition is disposed of as above.
