Rakesh Kumar Garg, J. (Oral):

As per the allegations made in this petition, despite the order
dated 12.11.2009 granting him interim bail, the respondents have arrested
the petitioner on that very day and, therefore, according to the petitioner, the
respondents are guilty of committing contempt of this court.

Without going into merits of the averments made by learned
counsel for the petitioner, even if the allegations made by the petitioner are
deemed to be correct on their face value, this may amount to ‘criminal
contempt’ as defined under Section 2(c) of the Contempt of Courts Act,
1971.

Faced with this situation, learned counsel for the petitioner
wishes to withdraw this petition with liberty to the petitioner to seek any
other appropriate remedy, in accordance with law.

With liberty aforesaid, this contempt petition is ordered to be
dismissed.
