By impugned order dated 13.04.2010 passed by Deputy Director of
Consolidation the matter has been remanded back before Consolidation
Officer to decide afresh after hearing the parties and affording opportunity to
adduce their respective evidence. In this view of the matter, the rights and
interest of parties, in my considered opinion, has not been impaired by the
impugned order passed by Deputy Director of Consolidation. After decision
of Consolidation Officer, the aggrieved parties would have again opportunity
to prefer appeal and revision. Accordingly, I do not find any justification to
interfere in the matter at this stage. The writ petition stands dismissed
accordingly.
