Heard learned counsel for petitioners as well as learned Public Prosecutor for State and perused the relevant documents placed before me.

Contention of the learned counsel for petitioners is that petitioners have been falsely implicated in the present case inasmuch as, petitioners and complainant party are trading in liquor and there are inter-alia dispute between the two and for that purpose, criminal case has been instituted against the petitioners. Vehicle has been recovered at the instance of the petitioners but from an open place. Learned counsel submitted that petitioners are in jail since 16/6/2010. Learned counsel submits that there are four more cases pending against petitioner No.2-Jarnel Singh whereas, there is only one case against petitioner No.1-Girraj Singh and they may be granted bail particularly when the investigation is still pending.

Learned Public Prosecutor has opposed the bail application.

Learned counsel for petitioners sought permission of this Court to withdraw the bail application of petitioner No.2-Jarnel Singh with liberty to apply for bail after challan is filed.

Consequently, this bail application u/S.439 Cr.P.C. of petitioner No.2-Jarnel Singh is dismissed as withdrawn with liberty to apply for bail after challan is filed.

Having regard to the facts aforesaid and considering all other facts and circumstances of the case, I deem it just and proper to enlarge petitioner No.1-Girraj Singh on bail.

In the result, this bail application of u/S.439 Cr.P.C. of petitioner No.1 is allowed and it is directed that petitioner No.1 Girraj Singh S/o Shri Deedar Singh shall be released on bail in FIR No.100/2010 P.S. Baroda Mev, District Alwar for offence u/Ss.382 and 395 IPC on his furnishing a personal bond in the sum of Rs.30,000/- together with two sureties in the sum of Rs.15,000/- each to the satisfaction of the concerned Court for his appearance before that court on all dates of hearing until conclusion of the trial.
