                                        ----------------------------------

4 11-11-2011 Heard the parties.

From paragraph 6 of the show cause filed on

behalf of opposite party no.4, it appears that Officer-

in-charge of Shakurabad Police Station within

Jehanabad district has taken a categorical stand in letter

dated 12-7-2010 addressed to Superintendent of Police,

Jehanabad that entire building of the Primary Health

Centre including the Malkhana has been vacated and

the doctors are running the Health Centre without any

obstruction/ impediment.

2

Learned counsel for the petitioner submits

that some residential quarters meant for the doctors are

still being occupied by police personnel including the

Officer- in-charge. According to him the direction in

public interest for vacating the premises of Primary

Health Centre would include residential quarters of that

Centre so that doctors can stay in the residential

quarters for proper functioning of the Health Centre.

Since the Primary Health Centre is said to be

running without any obstruction/ impediment, this

contempt petition is finally disposed of. In case the

doctors attached with the Primary Health Centre are

facing any inconvenience on account of occupation of

residential quarters meant for that Health Centre by

police personnel then the Incharge of the Health Centre

will be well advised to write a letter to the

Superintendent of Police, Jehanabad along with a copy

of this order and if such a letter for vacating the

residential premises is received by the Superintendent

of Police, Jehanabad from the Incharge Health Centre

then the Superintendent of Police shall take suitable
3

steps to ensure that the residential quarters are also

vacated at the earliest, preferably, within three months.
