Heard learned counsel for the applicant, learned A.G.A. and
perused the entire record of the case.
The submission of learned counsel for the applicant is that as
alleged in the FIR, accused applicant and co-accused Madan
assaulted Mohammad Intsar @ Manna (injured) by knife. The
injury report reveals only one injury on the person of the injured.
It is further submitted that in the statement of the injured, the
story has been changed and the role of assaulting has been
assigned to co-accused Madan and the applicant has only been
assigned the role of catching hold. The applicant is in jail since
13.11.2009, as mentioned in para 7 of the bail application , which has
not been controverted by the State.
Considering the overall aspects of the matter, I hereby provide
that applicant be released on bail in Case Crime No.492 of 2009,
under Section 307 IPC, P.S. Jahangirabad, District Barabanki,
on his filing a personal bond and two sureties each in the like
amount to the satisfaction of the court concerned.
