ORDER
It
is submitted by Mr.Rao, learned Advocate for respondent nos.4 to 8
that there was no stay for one month and thereafter in pursuance of
the order dated 29.03.2011 passed by this Court, present petitioners
have taken over the charge. It is submitted by Mr.Rao, learned
Advocate that appeal is pending before the Additional Registrar
(Appeals), Cooperative Societies, Gujarat State, Gandhinagar and
matter is fixed on 06.07.2011 for final hearing.
In
view of above, Additional Registrar (Appeals), Cooperative Societies,
Gujarat State, Gandhinagar is hereby directed to decide the appeal
after giving opportunity of hearing to both the parties on
06.07.2011. It is submitted by learned Advocates for respective
parties that they will not ask for any adjournment and will cooperate
before Appellate Court for proceedings with the matter.
Additional
Registrar (Appeals), Cooperative Societies, Gujarat State,
Gandhinagar is directed to decide the matter on 06.07.2011 without
influenced by the order dated 29.03.2011 passed by this Court.
Order
dated 29.03.2011 passed by this Court is hereby continued till final
disposal of the appeal.
Office
is directed to send copy of this order to Additional Registrar
(Appeals), Cooperative Societies, Gujarat State, Gandhinagar by fax.
Direct
service is permitted.
In
view of above, petition is disposed of.
