ORAL ORDER
Looking to the nature
of the controversy involved in the matter, the learned Advocate
General was requested by the Court to look into the matter. On his
persuading the authorities, the authorities have decided to withdraw
order dated 21st July, 2008 which is the subject matter of
challenge in this petition.
The
learned Advocate General apprises the Court about the development
which took place on 8th July, 2008 i.e. prior to order
dated 11th July, 2008 passed by this Court in Special
Civil Application No.9207 of 2008.
Now
that the authorities have decided to withdraw the order the Court is
not examining the question.
The
Court will be failing in its duty if the Court does not place on
record the appreciation of the sincere efforts put in by the learned
Advocate General in resolving the matter. But for the efforts of the
learned Advocate General, the matter would not have been resolved.
In
view of the withdrawal of the order under challenge dated 21st
July, 2008, the learned Advocate for the petitioner seeks permission
to withdraw the petition. Permission, as prayed for, is granted.
Notice is discharged. Interim relief, granted earlier, is vacated.
The petition is disposed of accordingly.
