Heard learned counsel for the applicant, the learned Additional
Government Advocate and perused the F.I.R. and other relevant
papers filed in support of the bail application.
Submission of the learned counsel for the applicant is that co-
accused Shiv Poojan Singh has already been granted bail vide
order dated 4.10.2006 passed by this Court in Crl. Misc. Case
No.3494(B) of 2006. As alleged in the F.I.R. three persons
including the applicant participated in committing the crime. The
applicant is in jail since 24.5.2006, as averred in para 2 of the
application. Learned counsel for the applicant submits that the
applicant is not a previous convict and the same is admitted by the
learned Counsel for the State, according to their instructions.
Considering the facts and circumstance of the case, let the
applicant be released on bail in case Crime No.271 of 2006 under
section 392 I.P.C., P.S.Baldirai, District Sultanpur on his filing a
personal bond and two sureties each in the like amount to the
satisfaction of the court concerned/remand Magistrate.
