1. Heard
learned advocate Mr.Sunil L. Mehta for the applicant, learned
advocate Mr.Shastri for respondent No.1 and learned A.P.P. Mr.A.J.
Desai for respondent No.2-State.

2. Considering
the averments made in the application and the reasonings given by the
learned Additional J.M.F.C., Limkheda in Criminal Case No.844 of
2004, I am of the view that the prayer as set out in the application
to grant leave to file an appeal is required to be granted.
Accordingly, the same is granted.

3. In
view of the above, the application is allowed.
