ORAL ORDER

Ms.

Yajnik, learned advocate representing OL has submitted that different
lists giving details of workmen have been placed on record by
different Unions wherein the total number of workmen and the claim
amount are differing. One of the Unions representing the workmen has
alleged that several ghost workmen have been included in the list.
One of the secured creditor has submitted that there are several
anomalies as well e.g. whether the staff member would be entitled to
claim payment under Section 529 of the Act or not.

So
far as the 3 different lists containing different number of workmen
and different claims and the application filed by another set of 14
workmen i.e. Company Application No. 193 of 2010 are concerned, Ms.
Yajnik, learned for the OL has submitted that office of OL will
undertake preliminary exercise of verification of list and preparing
brief summary of the details in the 3 lists and all details about the
workmen whose names are mentioned in three different lists and the
claim amount shall be placed on record within period of one week.

So
as to enable learned advocate for the OL to undertake said exercise,
and to consider the possibility of constituting a committee who can
examine each of the claims and verify the record so as to ascertain
the actual number of workmen as per the date of closer or as on the
date of winding up.

For
the aforesaid purpose, for the present the applications are adjourned
to 06.07.2011.
