Considering
the facts and circumstances, the applicant Board is permitted to be
impleaded as party in the main Misc. Civil Application No.2649/09
and Mr. Raval has stated that he would appear for the Board.
The
learned counsel appearing for the applicant submitted that there
shall be two representatives of the Trust and two representatives
of the Board in the selection committee.
However,
it appears that on behalf of the Trust, since there was inter se
dispute amongst the trustees, this Court has authorised a
representative who may be nominated by the Charity Commissioner to
represent the Trust and therefore, the same would separately take
care of the interest of the Trust. So far as two representatives
of the Board are concerned, DEO is also a Government officer and
the Board can authorise him being representative and another
representative of the Board is already permitted in the committee.
Hence,
no further direction is required for the constitution of the
selection committee. In any case, Civil Application No.2649/09 with
Civil Application No.13518/09 will have to be heard further after
the selection process is over.
Hence,
the present application subject to the aforesaid observation is
disposed of.
