This
application has been preferred for condoning delay of 197 days in
preferring the proposed LPA. While other respondents have not filed
any affidavit opposing the prayer, 2nd
respondent has filed affidavit opposing prayer for condonation of
delay. From the record it appears that the counsel appearing on
behalf of the appellant in the original writ petition was elevated as
a High Court Judge, and later on applicant could come to know of the
order from the Registry of the High Court. It is stated that
applicant tried to find out whether any notice
was received from the Registry, but no such notice could be traced
out and therefore, appeal could not be preferred within the time.

Having
heard counsel for the parties and on being satisfied with the
grounds, we condone the delay of 197 days in preferring the appeal.
CA No. 8115 of 2010 stands disposed of.

Let
LPA be listed before appropriate Bench on 27.1.2011.
