ORDER
1. Today,
learned advocate Mr.M.D.Pandya appearing for applicants has filed
sick note. Therefore, learned advocate Mr.Murli Devnani is appearing
for learned advocate Mr.Pandya on behalf of applicants.
2. Present
application is filed with a prayer to recall the order passed by this
Court on 28.4.2000 in Second Appeal No.429 of 1982.
3. I
have considered averments made in restoration application by
Corporation supported with affidavit of advocate Ms.Maya Desai dated
21.4.2006. The order passed by this Court in absence of advocate and
for that, specific reason has been given by applicants’ advocate in
present application. Therefore, order passed by this Court on
28.4.2000 in Second Appeal No.429 of 1982 is recalled and Second
Appeal No.429 of 1982 is restored to original file. Accordingly,
present application is disposed of.
4. The
Registry to notify Second Appeal No.429 of 1982 on 1.2.2011 for
final hearing in admission Board. The Registry is also directed to
show the name of learned advocate Mr.Amar Mithani as appearing on
behalf of respondent.
