ORAL
ORDER

(Per
: HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA)

ORDER
IN MCA:

It
appears that the Court’s order to remove defects as passed on 20th
December 2010 having not complied with, Letters Patent Appeal No.
2923 of 2010 was dismissed on 13th January 2010. Having heard
learned counsel for the petitioner, and being satisfied with the
explanation, we allow the petition and restore the Letters Patent
Appeal NO.2923 of 2010 to its original number.

ORDER
IN LPA:

When
the matter was taken up, learned counsel for the appellant submits
that pursuant to the order passed by the learned Single Judge, the
representation of the respondent was considered and rejected. Even
the appeal preferred against said order was also dismissed.
Therefore, the appeal has become infructuous.

In
view of the aforesaid fact, no further order is required to be
passed. Letters Patent Appeal stands disposed of.
