It has been contended by Mr. R.S. Verma, learned counsel for the
revisionist that in the FIR and in the whole statemenets recorded by the I.O.
there is no whisper as to who was cheated by the revisionist and what forgery
was committed by him, therefore, there was no evidence to frame the charge.
Issue notice to the opposite party no.2 to file counter affidavit within a
period of 3 weeks’. Rejoinder, if any, may be filed within 1 week thereafter.
List thereafter.
Till the next date of listing, further proceedings of Case No.501/9 of 2010
arising out of case crime no.49 of 1996, under Sections 419, 420, 467, 471,
IPC, P.S. Mugalpura, District Moradabad shall remain stayed.
