The petitioners have solemnized their marriage amongst themselves on

29.3.2009 at Arya Samaj Mandir, Sector-56, Palsora, Chandigarh according to Hindu

rites and ceremonies. The marriage certificate (Annexure P3) and the photographs

(Annexure P4) of the marriage have been placed on record. On account of the

marriage which has been solemnized by the petitioners, they apprehend danger to

their life and liberty from respondent No.2 who is the father of petitioner No.1.

Therefore, they have approached this Court.

It is submitted that both the petitioners are major. The date of birth of

petitioner No.1 as per her matriculation certificate (Annexure P1) is 26.2.1982. The

age of petitioner No.2 as on 1.1.2006 is 26 years as per the Identity Card (Annexure

P2) issued by the Election Commission of India. It is submitted that his date of birth

is 21.11.1977. Petitioner No.1 is a Staff Nurse at Dayanand Medical College &

Hospital Ludhiana. Copy of her Identity Card (Annexure P5) has also been placed on

record. By way of the present petition, the petitioners seek protection from

respondent No.2.

Both the petitioners are present in Court and are identified by their

counsel. It is submitted by petitioner No.1 that she has solemnized her marriage with

petitioner No.2 of her own free will and without any kind of pressure or undue

influence. Besides, she is happy with her marriage.

Keeping in view the facts and circumstances of the case, the criminal

miscellaneous petition is disposed of with a direction to Senior Superintendent of

Police, Bathinda (respondent No.1) that in case the petitioners approach him setting

out their grievances as have been made in the present petition, the same would be

looked into by him independently and in accordance with law.
