This is a petition for regular bail pending trial under Section
439 of the Code of Criminal Procedure, 1973 (for short,’Cr.P.C.’) in a case
registered vide FIR No.141 dated 06.7.2010, under Sections 323,324,506
and 307 IPC, at Police Station City Dabwali.
Learned counsel for the petitioner submits that he is in custody
since 20.7.2011 and the allegation against him is of causing grievous
injuries which have been found to be dangerous to life. He also submits that
the petitioner is neither a previous convict nor is wanted in any other case.
It is further submitted that the injuries are alleged to have been caused by
the petitioner on 6.7.2011, whereas the complainant was examined on
15.7.2010 on the basis of which the doctor has reported “Fracture of high
frontal bone is seen on left side with some displacement of the fractured
segment”. He submits that no witness has been examined by the
prosecution so far.

After hearing the learned counsel for the parties and taking
into consideration the facts and circumstances of the case but without
making any observations on the merit, the present petition is allowed and
the petitioner is directed to be released on bail on his furnishing bail bonds
to the satisfaction of the learned trial Court.
