The instant writ petition has been filed by the petitioner to allow him to run
the charcoal furnace at Raebareli.

Learned counsel for the petitioner has drawn the attention of the Court to the
notification dated 14.8.1997 by which the Babool wood has been exempted
and in view of above, no such permission is required for using Babool wood
in the charcoal furnace and it is the specific case of the petitioner that he is
using Babool wood in his charcoal furnace situate at Raebareli, which is being
run by him since 1994. The petitioner was duly granted permission as
required at that time.

Since no such permission is required, therefore, no order would be passed in
this regard and the petitioner is free to run his charcoal furnace accordingly.
However, in case the petitioner uses other wood in his charcoal furnace then
the authorities are free to take action in accordance with law.
Subject to aforesaid direction, the petition is disposed of finally.
