Learned
counsel for the petitioner submits that Mr.A.U.Patel Committee having
been superseded by Justice R.J.Shah Committee (Retd.) and the
subsequent Committee having submitted report about fees structure for
the same period, this application has become infructuous and
therefore, petitioner now intends to challenge the fees as prescribed
by the Justice R.J.Shah Committee (Retd.).
Such
contention made by the learned counsel for the petitioner is not
opposed by the learned counsel appearing on behalf of the
respondents. In the facts and circumstances, when we declare that the
writ petition has become infructuous, allow the petitioner to
challenge the fees prescribed by Justice R.J.Shah Committee (Retd.).
The
Special Civil Application stands disposed of with aforesaid
observations.
