1. When the stay application has come up for consideration, the learned Chartered Accountant prayed for time. It is noticed that the party is known to Member (J) and he does not want to hear this matter. Therefore/the matter is to be placed before the Hon’ble President for hearing before an appropriate Bench. The learned CA submits that till such time the stay application is heard, there can be an interim Order staying the recovery, as the party apprehends coercive methods for recovery.
2. Heard learned SDR.
3. The prayer is accepted. Till such time the matter is listed for hearing before an appropriate Bench by an Order of the Hon’ble President, no coercive steps should be taken for recovery. The Registry shall. transmit these records forthwith today itself by Speed Post to the Registrar, CESTAT, New Delhi, for placing it before the Hon’ble President for direction.
