ORAL
JUDGMENT

1. Rule.

Shri Mehul Shah, learned advocate waives service of notice of Rule
for the respondent original plaintiff.

2. With
the consent of the parties, application is taken up for final hearing
today. The present application is preferred by the applicants
heirs of the original petitioner permitting them to be joined as
petitioner Nos.1/1 and 1/2 in the main Revision Application
No.210/1996, as legal heir and guardians of original petitioner.

3. Having
heard the respective parties, as the application is not seriously
opposed by Mr. Mehul Shah, learned advocate for the respondent,
Prayer in terms of para 5(B) is hereby granted. Rule is made
absolute accordingly.

4. The
Registry is directed to amend the cause title of main Revision
Application on or before 3rd
May 2010.
