Allahabad High Court
Hari Kant Mishra vs Sri Rajendra Bhonwal And Another on 9 July, 2010
Court No. - 3

Case :- CONTEMPT No. - 1409 of 2010

Petitioner :- Hari Kant Mishra
Respondent :- Sri Rajendra Bhonwal And Another
Petitioner Counsel :- Vinay Tripathi,Ved Prakash Sharma

Hon'ble Shri Narayan Shukla,J.

The petitioner claims the disobedience of order dated 10th of June, 2010,
passed in writ petition No.3934 (SS) of 2010, whereby the order of
suspension dated 26th of May, 2010 has been stayed.

The learned counsel for the petitioner submits that though the petitioner has
been reinstated in service by means of order dated 17th of June, 2010, but he
has been transferred to another place, accordingly he claims the disobedience
of stay order.

Whereas I am of the view that once the petitioner has been reinstated in
service, he cannot claim any disobedience of order passed on 10th of June,
2010. So far as his grievance against the transfer is concerned, that is open
him to challenge before the writ court, if the same suffers from any error,
therefore, I am of the view that there is no contempt of the order passed by
this court. Accordingly the contempt petition is dismissed.
