Petitioners had participated in the selection process initiated by the respondents for the post of Prabodhak included in the Schedule appended to the Rajasthan Panchayati Raj Prabodhak Service Rules, 2008 vide advertisement dt. 31/05/2008 but their candidature was not considered on the premise that the teaching experience certificate enclosed by him was from outside the State of Rajasthan, which was not considered by the respondents while considering his candidature.
Counsel for respondents Mr. NA Naqvi, AAG, on instructions, submits that those, who were having teaching experience certificate of the institution outside the State of Rajasthan, were permitted to participate subject to its verification.
It is always open for the respondents to verify the experience certificate obtained by the petitioner but the petitioners cannot be denied from participating in the process of selection initiated in pursuance of advertisement dt. 31/05/2009.
Consequently, the writ petition succeeds and is allowed. The respondents are directed to consider the candidature of the petitioner for appointment on the post of Prabodhak in pursuance to the advertisement dt. 31/05/2008 if they are otherwise found to be eligible/suitable and if the petitioner is found to be ineligible or unsuitable, he may be intimated thereof assigning reason. Necessary compliance be made within a period of three months.
