Heard
learned counsel for the parties.
The
applicant – original defendant has preferred this application
with a prayer to provide certified copy of the original Bills of
Lading [Exhibits A, B & C] produced by the plaintiffs in
Admiralty Suit No.3 of 2008 kept with the Registry of this Court in a
sealed cover.
In
an identical application being Civil Application No.530 of 2010 in
Admiralty Suit No.3 of 2008 preferred by an officer of the Delhi
Police, this Court has allowed such prayer.
In
view of the above and considering the facts and circumstances of the
case, when the applicants are the defendants in the suit, I hereby
direct the Registry to provide certified copy of the original Bills
of Lading [Exhibits A, B & C], which are kept in sealed cover,
by following proper procedure and after supplying the certified copy
of the documents at Exhs. A, B & C, same may be again kept in
sealed cover.
With
the aforesaid, this application stands disposed of. However, there
shall be no order as to costs.
