Dated this the 7th day of January, 2008.

                               JUDGMENT

Balakrishnan Nair, J:

The petitioner has approached this Court contending inter alia

that their members are being obstructed by respondents 5 and 6

and their members, from doing work under the 1st respondent,

though the said respondent, who is the employer, is willing to

engage them. We directed the learned counsel for the 1st

respondent to get instructions on this point. The learned counsel,

after getting instructions, submitted that the 1st respondent is not

willing to engage the workmen represented by the petitioner. If

that be so, the petitioner’s remedy to get employment lies else

where. Therefore, this writ petition is closed without prejudice to

the contentions of the petitioner and its right to approach this

Court, if cause of action arises in future.

P.N. RAVINDRAN, JUDGE.
