whereby this writ petition was dismissed for non prosecution. This
application is supported with an affidavit and has been made
within time. The reasons shown for non appearance of learned
counsel for the petitioner on 22.10.2009 when the writ petition was
dismissed for non prosecution is sufficient. The application is
allowed. The order dated 22.10.2009 is recalled and the writ
petition is restored to its original number.

No order is passed as to costs.
