Customs, Excise and Gold Tribunal – Bangalore
Hindustan Aeronautics Limited, … vs The Collector Of Customs, … on 23 October, 2001
JUDGMENT
S.S. Sekhon
1. Case called. None appeared on behalf of the appellants. The appellant company being a Public Sector Undertaking, clearance is required from the Committee of Secretaries as observed by Supreme Court in the case of ONGC Vs. Collector of Central Excise reported in 1992 (61) ELT 3 (SC) as well as in its clarificatory judgment reported in 1994 (70) ELT 45. No clearance has been placed on record. In these circumstances, this appeal is dismissed for want of clearance. However the party is at liberty to file the application for revival as and when the clearance is produced.
2. Ordered accordingly.
