ORDER
1. The petitioner is
before this Court being aggrieved by an order passed by the Special
Secretary, Revenue (Appeals) in MVV/Hakk/ST/66/10 dated 30.10.2010
(Annexure-K), whereby the SSRD was pleased to reject the application
for interim relief.
2. Learned Senior
Advocate Mr.Kavina appearing with learned Advocate Mr.Diraj M.Patel
for the petitioner submitted that if this order is allowed to
operate, whereby the entries in favour of the petitioner, who is the
purchaser of the land in question by registered sale deed, may be
dealt by the parties and may unnecessarily create interest of third
party and may add to multiplicity of proceedings.
3. The submission is
found acceptable and therefore, the authorities are directed to keep
all the four entries in a ‘Disputed Entry Register’, so as to see
that any person, who proposes to purchase this property, will be put
to notice that the property is having a pending litigation.
It goes without saying
that the revenue entries are only for fiscal purpose and they do not
decide title of the property and that is why, all these entries will
be subject to outcome of Regular Civil Suit No.449 of 2010 filed in
the Court of learned Principal Senior Civil Judge, Surat.
4. With these
observations, the petition is disposed of.
