                       JUDGMENT

All the petitioners herein are working as Junior

Public Health Nurses Grade-I in Thrissur District. They have

a common grievance, inasmuch as that, they belong to

Districts other than Thrissur and they are entitled to get

inter-district transfers to their native districts. Though they

have submitted representations in this regard, as evidenced

by Exts.P1 to P7, their apprehension is that their applications

for transfer may be ignored in the course of General Transfer,

2008.

2. I have gone through the writ petition and I am

satisfied that if the statements made in the writ petition, as

regards the personal reasons which prompt the petitioners to

seek a transfer, are factually correct, then sincere efforts may

be taken, by the Director of Health Services, to accommodate

the petitioners in their native districts. This is especially so

in the case of petitioners 1, 2, 3, 4 and 7. I also take note of

the fact that the petitioners have completed 5 years in

Thrissur District and therefore, relaxation of the 5 year rule,

at the hands of the Government, may not be required in

their case.

3. In the result, the writ petition is disposed of

directing the 1st respondent to specifically consider the

requests made in Ext.P1 to P7, in the course of General

Transfer of 2008. If there is any reason for the petitioners’

request not being accepted, the 1st respondent shall give

them notice and an opportunity of hearing before a

decision is taken on Exts.P1 to P7.

The petitioners shall produce a copy of this

judgment along with a copy of the writ petition before the

1st respondent for compliance.
