2. Heard the learned counsel for the applicant Ibrar Ahmad, the learned AGA
for the State and perused the record.
3. In the connected petition the proceedings being held in pursuance of the
impugned order under section 319 CrPC have been stayed. l
4. Notice on behalf of the respondent no.1 has been accepted by the AGA.
Issue notice to the respondent no.2 by registered post, returnable at an early
date.
5. Counter affidavit may be filed within four weeks and the rejoinder
affidavit, if any, within two weeks thereafter. List in the month of July 2010.
6. Meanwhile further proceedings in S.T. No. 113/2009 arising out of crime
no. 290 of 2008 under sections 147, 148 and 307 IPC, police station Kandhai,
district Pratapgarh, shall remain stayed.
