12. 16.11.2010 I.A. No. 8804 of 2010 has been filed on behalf of
the petitioner in CWJC No. 11223 of 2004 for adding the
Builder/Developer of the property in dispute, as party respondent.
Considering the facts and circumstances of this case, this interlocutory
application is allowed. Let the Builder/Developer be added as
Respondent no. 10 to this writ petition, whose details are as follows:
“Anil Kumar, Managing Director,
Patliputra Group of Companies,
Patliputra Builders Ltd., 301,
Maharaja Kameshwar Complex,
Frazer Road, District- Patna.
In view of the aforesaid order I.A. NO. 1370 of
2006 filed by the said Builder/Developer is disposed of.

I.A. NO. 8806 of 2010 has been filed on behalf of
the petitioner in CWJC No. 11223 of 2004 for substituting the heirs of
Petitioner No. 1 Bageshwari Prasad Shrivastava, who is said to have
died on 14.07.2008 leaving behind a son and two daughters as his
heirs and legal representatives fully detailed in paragraph 1 of the
interlocutory application. Considering the facts and circumstances,
this interlocutory application is allowed. Let the aforesaid heirs of
petitioner no. 1, who have also filed their Vakalatnama, be substituted
in place of petitioner no. 1.
Let notice be issued to Respondents no. 10 under
registered post with A/D for which requisites etc. must be filed by the
petitioner within one week failing which this writ petition as against
the concerned respondent shall stand rejected without further
reference to a Bench.
