ORDER
This
application is preferred by the mother of the applicant – an
under trial prisoner who is arrested on 23.05.2009 for the offences
punishable under Sections 302 and 34 of the Indian Penal Code and is
imprisoned at the Sabarmati Central Jail.
In
this application, the mother of the applicant appears and has
produced a Medical Certificate issued by a qualified surgeon which
reveals that the wife of the applicant is to undergo hysterectomy
and she is under the surgeon’s treatment and further, the operation
is scheduled on August 5, 2011.
Considering
the ailment of the wife of the applicant – an under trial
prisoner and the medical
certificate which has been verified by the Police Sub Inspector,
Satellite Police Station, Ahmedabad City, I deem it just and proper
to grant fifteen (15)
days of temporary
bail to the applicant – an under trial prisoner, from the date
of his release, on furnishing a surety of Rs.5,000/= (Rupees Five
Thousand Only) to the satisfaction of the jail authority. During
the period of temporary bail, the applicant – an under trial
prisoner shall mark his presence once in a week before the Satellite
Police Station, Ahmedabad City.
On completion of the period of temporary bail, the applicant –
an under trial prisoner shall surrender in time before the jail
authorities.
With
the aforesaid observation and direction, this application stands
disposed of. Direct Service is permitted.
