Leave
to amend.

1. NOTICE
to the newly added party respondent – Chief Secretary to the
Government of Gujarat, Sachivalaya, Gandhinagar. Notice on behalf
of the Chief Secretary is waived by Mr Kartik Pandya, learned APP.

Heard
the learned Advocates for the parties.

2. This
Court has not entered into the merit of the case in view of the
statement made by Mr Tushar Mehta, learned AAG appearing for the
respondent-State.

3. It
is stated by Mr Tushar Mehta, learned AAG that the representation
dated 2.12.2009 made by the petitioner is the subject-application
under section 19 of the Prevention of Corruption Act, 1988 which
will be decided by the Chief Secretary, Government of Gujarat, in
accordance with law within eight weeks from the date of
receipt of the order of this court.

4. In
view of the above, the Chief Secretary, State of Gujarat is directed
to decide the above representation within eight weeks from the
date of receipt of this order. This petition stands disposed of.
Notice is discharged. Direct service is permitted.
