                               JUDGMENT

This petition is filed by the petitioner, the mother of a

deceased person, to transfer the investigation of Crime No.703 of

2005 of Fort Police Station to the 4th respondent for investigation.

Connected Crime No.704 of 2005 has already been transferred for

investigation by the 4th respondent and the investigation is

already in progress. The learned counsel for the petitioner prays,

the learned Standing Counsel for the 4th respondent-C.B.I accepts

the said prayer and the learned Public Prosecutor for respondents

1 and 2 does not oppose the said prayer – that the investigation of

Crime No.703 of 2005 may also be transferred for investigation to

the 4th respondent.

2. I am satisfied that the said request can be accepted.

As all concerned are in agreement, it is not necessary to advert to

facts in any greater detail. I am satisfied that the investigation

into these two crimes are so integrally connected, that the prayer

deserves to be allowed.

3. In the result:

i) This Writ Petition is allowed;

W.P(C). No.12365 of 2008 2

ii) Crime No.703 of 2005 registered at the Fort Police

Station, Trivandrum is transferred for investigation to the 4th

respondent.
