13.7.2011.

The substitution application i.e.

I.A. No. 763 of 1999 and the limitation

application at Flag ‘R’ have already been

dismissed as far back as in the year 1999

for non-compliance of the order dated

3.5.1999. The said substitution application

was filed for substitution of the legal

representatives of the deceased respondent

Nos.1 and 2. Since the substitution

application and limitation application have

been dismissed, there is no other

respondent in the appeal. In my opinion

therefore, the whole appeal has become

incompetent to proceed.

Accordingly, this first appeal is

dismissed as incompetent.
