Heard Sri Ram Lagan Misra, learned counsel for the petitioner and Sri
J.N.Verma, for the opposite party Nos. 3 to 5. Learned Standing counsel
appears for opposite party No.s 1 and 2 while Sri M.S.Rathore appears for the
caveator.
Petitioner has been placed under suspension for certain reasons which have
been shown in the suspension order itself.
These are factual disputes which can not be looked into by this Court but this
will be done in the inquiry. Counsel for the petitioner apprehends that
normally when a person is suspended the inquiry is not conducted for a very
long time and the person suffers a social stigma.
Accordingly, this Court directs the opposite parties to complete the inquiry
within a period of four months. The opposite parties will issue charge sheet to
the petitioner, if not issued, within a period of fifteen days from the date a
certified copy of this order is placed before him. Petitioner will file reply to
the charge sheet within fifteen days from the date charge sheet is received by
him. Thereafter, the opposite parties shall proceed to conclude the inquiry
within a period of three months.
Petitioner shall cooperate with the inquiry failing which this order shall be of
no avail
However, in case, despite cooperation of the petitioner the inquiry is not
completed, the petitioner shall have the liberty to approach the Court once
again.
With these observations and directions the writ petition is finally disposed of.
