3 06.07.2011 Petitioner assails order dated 1.8.2007

(Annexure-1) whereby he was placed under order of

suspension.

It is admitted position that petitioner

superannuated from service w.e.f. 30.6.2011. In that view of

the matter, the present application has become infructuous.

Learned counsel for the petitioner submits that

along with petitioner, one Arun Kumar Sinha was also

suspended. On consideration of explanation, his suspension

was revoked by order dated 9.1.2008 (Annexure-4) and

subsequently, by yet another communication dated

21.10.2008, he was allowed to draw full salary for the period

of suspension. It is the stand of the petitioner that the

petitioner had already submitted his explanation on

24.5.2007 (Annexure-3) but the matter remained pending.

Since the main grievance of the petitioner has

found to become infructuous, this Court grants liberty to the

petitioner to approach the respondent for the remaining

grievance, if any, by filing a detailed representation along

with a copy of the present order within a reasonable period

of time. If any such application is filed, the concerned

respondent shall take appropriate decision in accordance

with law as quickly as possible, preferably within three

months from the dates of its filing.

With the liberty and observation aforesaid, the

application is dismissed.
