Learned counsel for both the parties agreed
that this writ petition may be disposed of in the
light of the directions issued in SBCWP
No.5667/2006 (Vinod Kumar vs. State & Ors.)
decided on 20.8.2007.
In view of the admitted case of both the
parties, this writ petition is also disposed of
with a direction to the respondents no.1 and 2 to
consider the case of the petitioner for grant of
interest on the amount refunded in accordance with
law within a period of three months from today.
While considering the claim of the petitioner, the
respondents shall also keep in mind the law laid
down by this Court in the case of Chotha Ram vs.
State of Rajasthan (SBCWP No.3671/2002).
In view of the fact of disposal of the writ
petition, the presence of the concerned person is
dispensed with and since the writ petition has
been decided, he need not to appear.
