As per the averments made in this contempt petition, the petitioner,

who is working in a Government College as Lecturers, filed CWP No.6331 of

2000 for counting the benefits of adhoc service to get him senior scale/selection

grade as per UGC Letters dated 27.11.1990 and 25.12.1998. The aforesaid civil

writ petition was disposed of by the Division Bench of this Court vide order dated

22.09.2008 in terms of order dated 05.08.2008 passed in CWP No. 15272 of

2007, which reads as follows:-

“In view of the facts mentioned above, we direct the
Secretary, Higher Education, Punjab, Chandigarh to prepare
a cheque(s) for each of the petitioners for the amount due.

Needful be done within a period of seven days from
today, failing which officer concerned shall come present in
the Court on the next date of hearing.”

2. The grievance of the petitioner in this contempt petition is that

despite the aforesaid directions, passed by this Court, the respondents have

failed to decide the claim of the petitioner. In response to show cause notice,

issued by this Court, an affidavit of Ms. Maninder Kaur Dhillon, Director of Public

Instruction (Colleges) Punjab, Chandigarh was filed, wherein, it has been

submitted that in order to comply with the orders, passed by this Court, the

Department of Finance has provided a sum of Rs.25,58,523/-, which have been

disbursed to the Colleges’ Principals vide letter No.31/80-64-08-S(7) dated

11.12.2008 and the pay fixation of all such petitioners including the petitioner

have been done after verifying their service record. The bills of the petitioners

have been submitted to the Treasury by the respective Principals of the

Government Colleges in the State of Punjab and most of the petitioners have

been released the payment.

3. In view of the aforesaid reply filed and the fact that there is no

representation on behalf of the petitioners, I am not inclined to proceed further

in this petition.

4. However, if any of the petitioner has not been released the

payment, as mentioned in the affidavit of the respondent, submitted before this

Court, he shall be entitled to revive the present contempt petition.

5. Rule discharged.
