3/ 16-12-2010 Mr. Vinay Kirti Singh, learned counsel for the

petitioner submits that during the pendency of the present

civil revision application, the main Title Suit No. 117 of

1991, filed by the petitioner has itself been dismissed on

merit. Against the aforesaid judgment and decree of

dismissal the petitioner has preferred a title appeal before

the learned District Judge, which is still pending.

In that view of the matter, learned counsel for the

petitioner seeks permission to withdraw this civil revision

application with a liberty to raise issues involved in the

present application in that title appeal.

Permission is accorded.

The present civil revision application is dismissed

as withdrawn with a liberty to raise the issues herein in

the aforesaid title appeal before the learned appellate

court.
