Sri K.N. Misra, learned counsel appearing for the opposite parties has filed a
supplementary compliance affidavit, along with which is annexed the
accounts statement of the applicant’s account with the bank of which the
opposite parties are the officers. According to the accounts statement as on
date the amount lying in the account of the applicant is Rs.5,84,192.55p.
Annexure no.2 to the affidavit filed today is a letter written by the Senior
Branch Manager of the bank addressed to the applicant requesting him to
come and withdraw the amount as and when required by him on any working
day.
The learned counsel for the applicant has submitted that the opposite parties
are not permitting the applicant to withdraw the amount as desired by him.
They are only agreeing to release the amount of Rs.1,00,000/- and for
remaining they are insisting him to retain it with the bank and be kept in the
form of fixed deposits. In the circumstances the learned counsel for the
applicant has submitted that the opposite parties be directed to produce the
bank draft before the Court of the amount due and payable to the applicant
from his account. The learned counsel for the opposite parties has no
objection to the same.
In the circumstances at this stage let a bank draft of Rs.5,00,000/- be prepared
from the account lying in the account of the applicant with the bank of which
the opposite parties are the officers, drawn in the name of the applicant be
produced on the next date, which is being fixed as 6.8.2010.
Put up this case in the additional cause list on 6.8.2010.
