Heard learned counsel for the applicant and learned A.G.A. for the
State.
Submission is that similarly placed co-accused Kanhaiya has been
granted bail by this Court on 1.4.2010 in Criminal Misc. Bail
Application No. 5957 of 2010, Mohd. Rais has been granted bail
on 5.4.2010 in Criminal Misc. Bail Application No. 7925 of 2010
and Hajrat Ali has been granted bail on 30.4.2010 in Criminal
Misc. Bail Application No. 10336 of 2010. The case of the present
applicant is identical to that of co-accused who have been granted
bail.
Taking into consideration the facts and circumstances of the case,
without expressing any opinion on merits and on the ground of
parity, bail application is allowed.
Let the applicant Jalaluddin son of Insan Ali, involved in case
crime No. 11 of 2010, under Section 3/7 E.C. Act, Police Station
Kotwali Lotan, District Siddharth Nagar, be released on bail on
executing a personal bond and furnishing two sureties each in the
like amount to the satisfaction of the court concerned with the
following conditions:-
(i) The applicant will not tamper with the evidence during the trial.
(ii) The applicant will not pressurize/intimidate the prosecution
witness.
(iii) The applicant will appear before the trial court on the date
fixed.
In case of breach of any of the above conditions, the court below
shall be at liberty to cancel the bail.
